Raisin includes all the products and services offered by the Raisin community for professionals who meet the Raisin mobile app's criteria to be referenced. Raisin provides a personalized subscription service, renewable or not, that allows establishment owners to access and modify their establishment, either through the admin website or from their profile page directly on the Raisin app, as well as products available only to Raisin establishments.
Referencing criteria and eligibility
The selection criteria for establishments referenced on the mobile Raisin app and website are exclusively determined by the Raisin society, which reserves the right to modify these criteria, displayed on the Raisin and Raisin sites. An establishment's eligibility to fit these criteria is determined by the Raisin team, based on information provided by the establishment wishing to be referenced, in addition to information available on the internet such as social networks, in order to validate the entirety of the information. It is the responsibility of the establishment seeking to be referenced to provide all necessary and relevant information requested by the Raisin team, in the requested format. The establishment seeking to be referenced is also responsible for the accuracy of the information provided, that is related to their establishment. In case of doubt due to incomplete, seemingly incomplete, or inconsistent information, Raisin reserves the right not to reference the establishment.
The General Conditions of Use below govern the use of Raisin products and services
The terms “Raisin service,” “our services,” or “the services” used in this document refer to the personal services proposed to referenced establishment owners by Raisin or those who wish to be referenced on the mobile application Raisin, such as the ability to edit and publish certain contents of the establishment’s profile, the use of special features, access to the website and user interface, as well as the content and software associated with our services. The term “our products” used in this document refer to the goods and services proposed to referenced establishment owners by Raisin or those who wish to be referenced on the mobile application Raisin, such as annual storefront stickers, books, or paid referencing services offered in the form of a non-renewable subscription.
When you use our services and/ or products, you accept all of these present conditions. Your use of your services and purchasing of our products is also subject to our Cookie and Privacy Policies, which explain our methods of collecting, using, sharing, and storing your personal information.
1. Subscription
1.1. Raisin Services are available only via a renewable monthly or yearly subscription. Once activated, your renewable Raisin subscription (monthly or yearly) will be active until terminated. In order to use the Raisin services, you must have an internet connection, Raisin compatible equipment/device, and provide us with one or more payment method(s). By payment method, we mean a valid and accepted means of payment. Your payment method may be updated when necessary, and may include payment by a third party through your account. If you subscribe to a renewable subscription, your payment method will be automatically charged and you will be billed at the start of each subscription period for the applicable fees and taxes. To avoid being billed later, cancel your subscription before the renewal date. Find out how to cancel your subscription in section 3.4 titled “Canceling.”
1.2 Raisin products are only available via a non-renewable subscription. Once activated, your subscription for a Raisin product will be automatically cancelled after the first valid payment. In order to purchase a Raisin product, you must have internet connection, Raisin compatible equipment, and provide us with one or more valid method(s) of payment. By method of payment, we mean a valid and accepted means of payment. Your payment method may be updated when necessary, and may include payment by a third party through your account. If you subscribe to a non-renewable service, your method of payment will be automatically charged for the amount of the product, including any fees and taxes that may apply. Any product purchased for a service such as a paid listing, excluding a renewable subscription, will not be eligible for a refund. Any product purchased such as stickers or books will be expedited on behalf of the Raisin Team, and will not be eligible for a refund. In the event of a problem encountered and proven during shipment or of a defective product, a new shipment may be made. See section 3.6 “Defective or non-received products” for how to request a new shipment.
1.3 The User guarantees that all information given on the registration form is accurate, up-to-date, truthful, and not misleading.
2. Free Trials (only valid for Raisin Services)
2.1. Your renewable Raisin Subscription starts with a 14 day free trial. The duration of the free trial is intended to allow new members and certain former members to try the service. The purchase of any Raisin product does not commence a free trial.
2.2. Free trial eligibility is determined by and subject to Raisin's discretion, who reserves the right to limit eligibility or duration of the trial period to prevent free trial abuse. We reserve the right to revoke the free trial and suspend your account in the event that we determine that you are not eligible, or no longer meet the conditions of eligibility required by Raisin, as a professional. We may use information such as your device identification, method of payment, or an email address used with an existing or recent Raisin subscription to determine eligibility. For combinations with other offers, restrictions may apply.
2.3. The amount of the renewable subscription price will be invoiced to your payment method during the first billing cycle at the end of the trial period, unless you cancel your subscription before the end of the trial period. 3. Billing and Cancellation
3.1. Billing Cycle. Subscription fees for Raisin services and products will be charged to your payment method on the specific billing date indicated on the "Settings" page. The length of your billing cycle will depend on the type of subscription that you choose upon signing up for the service or purchase of the product. In some cases, your payment date may change, for example if your payment method is invalid, expired, or if the start date of your subscription corresponds to a day that does not exist in a given month. 3.2. Payment Methods. To use the Raisin service you must provide one or more payment method(s). By doing so, you authorize us to charge any payment method associated with your account, in the case that your primary payment method is declined or no longer available to us for payment of your subscription fee. You remain responsible for any uncollected amounts. If a payment is not successfully settled due to expiration, insufficient funds, or otherwise, and you do not cancel your renewable subscription before the billing date, we may suspend your access to the Raisin service until we have successfully charged a valid payment method. Depending on your method of payment, additional fees may apply such as foreign transaction fees or other fees relating to the processing of your payment. Local tax charges may also vary depending on the payment method used. Check with your service provider for more details.
3.3. Updating your payment method(s). You can update your payment method(s) by going to the payment service URL we will provide you. We may update your payment method(s) using information provided by your payment service providers. Following any update to your payment information, you authorize us to continue to charge the applicable payment method(s).
3.4. Cancellation. You can cancel your renewable Raisin subscription at any time, and you will continue to have access to the Raisin service through the end of your billing period. Payments are non-refundable and we do not provide credits for any partial or unused subscription periods of Raisin content. To change your plan, email our support: [email protected].
3.5 Once your subscription is canceled and the last billing period is over, you will no longer be able to edit or update the information on your establishment’s profile. Your establishment’s profile will be restored to its original state, which means: original design, no access to edit or update data, limited to 5 photos, no highlight on the home page, and 2-click access to the establishment (instead of one) on the Raisin app and website’s establishment map.
There is no guarantee that we will store or continue to display the information and content that you have previously posted. Raisin is not a storage service. You agree that we are under no obligation to store, maintain, or provide you with a copy of the information or content that you or others have transmitted to us other than the extent required by applicable law and as described in our privacy policy.
3.6 Defective or non-received products
Raisin products purchased through non-renewable subscription such as annual stickers or Raisin books, will be acquired through shipment from the Raisin team and/or its partners, according to the conditions indicated at purchase. If, upon reception, the product(s) are found to be defective or if not received within the time indicated by Raisin, encountered in transport or other reasons beyond our control, Raisin undertakes responsibility to resend the ordered product at Raisin’s expense. 3.7 Changes to the price and subscription plans. We reserve the right to modify our subscription plans and the subsequent prices of our services and products from time to time. In this case, any price changes or changes to your subscription plans will only apply after at least 30 days notice.
4. Raisin Services and Products
4.1. You must be 18 years of age or older, or of legal age in your province, territory or country, to become a user of the Raisin services and products. Minors may only use the services or products under the supervision of an adult.
4.2. The Raisin service and any content viewed through the service are strictly for your personal and non-commercial use only and may not be shared with individuals outside your establishment. While using Raisin subscription services, we grant you a limited, non-exclusive, non-transferable right to access the Raisin service and view Raisin content. Except for the foregoing, no right, title or interest shall be transferred to you. You agree not to use the service for public performances.
4.3 Raisin products purchased separately from renewable subscriptions, such as annual storefront stickers, are exclusively intended for commercial use of the establishment referenced on the Raisin app and website, which have been personally acquired and may not be transferred, assigned, or resold without prior agreement from the Raisin company. Raisin products purchased separately from renewable subscriptions such as Raisin books are intended to be sold exclusively by the establishment recommended on Raisin, which has personally acquired them and must in no case be transferred, assigned, or resold without prior agreement from the Raisin company.
4.4 You agree to only provide content and data that do not infringe on laws and do not violate the rights of anyone (or any intellectual property right). Furthermore, you guarantee the veracity of your profile information. In accordance with the laws of certain countries, we may be obliged to remove content and information.
4.5. The Raisin service and products, are regularly updated. In addition, we regularly test various aspects of our service, including our website, user interfaces, promotional features, and availability of Raisin content.
4.6 You agree to receive notifications and messages communicated to you by the following means: (1) in the Service or (2) sent to the contact details you have provided to us (for example: email, mobile phone, postal address). You agree to keep your contact information up to date.
4.7. You agree to not:
- archive, reproduce, distribute, translate, modify, display, publish, patent, or create any work derived from Raisin content, products, and services
- use (apart from what is authorized within the framework of our General Conditions of Use), rent, propose in lease, lend, market, sell/resell, or in any way monetize the products and services, contents, and information associated with or included in the Raisin services or access the above without our agreement.
- use any robot, computer bots, or any other program or automated means to access Raisin services
- decompile, reverse engineer, or disassemble any software, code, product, or process accessible via Raisin services
- insert code or product to manipulate the content of Raisin services in any way
- create deep links for any purpose other than promoting your establishment via our services, without our agreement
- monitor the availability, performance, or functionality of the services for competitive purposes
- use the technique of “framing,” “mirroring,” or in any way simulate the appearance of the services
- disrupt the operation of the services or impose a disproportionate load on them (ex. spam, denial of service attack, virus, game algorithm)
In addition, you agree not to download, publish, transfer by email or any method, any material intend to interrupt, destroy, corrupt, or limit the functionality of the equipment and software associated with or used by Raisin services, including any virus, code, program, or computer file. We reserve the right to terminate or restrict the use of our services to anyone who violates these Terms of Service, or anyone who is involved in the fraudulent or illegal use of our services.
4.8. The quality of the display of the Raisin content may vary from device to device, and may be affected by a variety of factors, such as your location, the bandwidth available through and/or speed of your Internet connection. You are responsible for all Internet access charges. Please check with your Internet provider for information on possible Internet data usage charges. The time it takes to begin using Raisin content will vary based on a number of factors, including your location, available bandwidth at the time, the content you have selected and the configuration of your Raisin ready device.
4.9. Raisin software is developed by, or for, Raisin and is designed to enable usage of Raisin content through Raisin ready devices. This software may vary by device and medium, and functionalities and features may also differ between devices. You acknowledge that the use of the service may require third party software that is subject to third party licenses. You agree that you may automatically receive updated versions of the Raisin and related third-party software.
4.10 Automated processing
We use data and information about you to provide you and others with relevant suggestions within the Raisin mobile app. We use the information and data you provide and which are available to us to propose recommendations to users of the Raisin app and website. By keeping your profile information current and accurate, you help us make our recommendations more relevant. The user is informed of the automated processing of their personal data in our cookie and privacy policy.
5. Intellectual Property Rights
You are informed of our intellectual property rights.
Raisin reserves all intellectual property rights related to Raisin Products and Services. The brand and logo used in association with Raisin Products and Services belong to Raisin. The logos and illustrations with Raisin marks that are used for our products and services are registered and trademarked.
6. Passwords and Account Access.
The User can always access their profile after being identified with their login name and password.The person who created the Raisin account and whose payment method is charged (the "Account Owner") has access and control over the Raisin account and the corresponding Raisin equipment that are used to access our service, and is responsible for any activity that occurs through the Raisin account. To maintain control over the account and to prevent anyone from accessing the account, the Account Owner should maintain control over the Raisin devices that are used to access the service and not reveal the password or details of the payment method associated with the account to anyone. The account owner is responsible for updating and maintaining the accuracy of the information you provide relating to your account. We can suspend or terminate your account in order to protect you, Raisin or our partners from identity theft or other fraudulent activity.
7. Guarantees and responsabilities
7.1 Limits of liability
We decline any responsibility to you or anyone for loss of use, data, customers, any loss of profit, or any related, indirect punitive damages whatever they may be regardless of the cause (even if we have been warned about the possibility of such damage), including loss and damage (1) resulting from loss of enjoyment, loss of data or failure to profit (predictable or not), (2) based on a basis of liability, including breach of contract of warranty, negligence, or any other tort action; (3) arising from any other compelling relating to your use of the services or products or your access to them. Nothing in these terms limits or excludes your liability for gross negligence, willful misconduct on our part or by our employees, or for death or personal injury.
7.2 Exclusion of Liability
Restrictions on our legal liability to you.
To the fullest extent allowed by law (and unless Raisin enters into a separate written agreement which cancels this contract), Raisin will have no liability coming from this contract for loss of profits or lost business opportunities, reputation (insults or defamatory comments), loss of data (such as interruptions or loss of your data or content, use thereof, or changes made) or any indirect, incidental, consequential, special or punitive damages. Raisin will not be liable to you in connection with this contract for amounts that exceed the total amount of fees paid or payable by you to Raisin for services for the duration of this contract, if applicable.
7.3 Guarantee
This constitutes our disclaimer regarding the quality, safety, and reliability of our products and services.
Raisin makes no declarations and gives no guarantee regarding products and services, including that the services will not be interrupted or error free, and provides the services (including the content and information) “as is” and “subject to availability.” To the extent permitted by applicable law, Raisin disclaims all implied or legal warranties, including all implied warranties of title, accuracy of data, absence of counterfeit, merchantability, or fitness for a particular purpose.
8. Miscellaneous
8.1 Applicable law and competent jurisdiction. These general conditions of use (GCU) are subject to French law. The precent GCUs may limit the protection of your consumer rights, as defined by the laws in place in your country of residence. In the event of a dispute, the parties agree to seek conciliation before taking legal action. If no amicable agreement is found between Raisin and the client, the French court will have sole jurisdiction unless otherwise provided in the legislation of the client’s country of residence.
No class action. You can only resolve disputes with us on an individual basis and you cannot file a complaint as a complainant or member of a collective class, taking joint or representative action.
8.2. Unsolicited Materials. Raisin does not accept unsolicited materials or ideas for Raisin content, and is not responsible for the similarity of any of its content or programming in any media to materials or ideas transmitted to Raisin.
8.3. Customer Support. To find more information about our service and its available features, or if you need assistance with your account, please visit the Raisin FAQ on our website. If you are unable to find the answer you are looking for, our team is at your disposal and can be reached by email at [email protected].
8.4. Survival. If any provision(s) of these GCUs are held to be invalid, illegal, unenforceable, or declared as such by a competent court decision, the validity, legality and enforceability of the remaining provisions shall remain in full force and effect.
8.5. Changes to Terms of Use. We can modify the present General Conditions of Use from time to time. If we make key material modifications, we will inform you 30 days in advance through our services or by other means of communication, in order to allow for the opportunity to review the upcoming modifications before they take effect. We recognize that changes cannot be retroactive. If you object to any of the upcoming changes, you can close your account. If you continue to use our services after you have been notified about the upcoming changes we have made to the present conditions and do not close your account, this signifies that you have accepted the conditions from their start date.
8.6. Electronic Communications. All information relating to your account (payment authorizations, invoices, changes in password or payment method, confirmation messages, notices) will be sent to you via email to the email address provided during registration by the account owner.
